Recreational marijuana is now legal in Oregon. Like other states, however, the drug’s distribution and use are still controlled by local laws. This is similar to alcohol. While the legality of recreational marijuana does open up some new business opportunities, cannabis business owners must know exactly what they are and are not allowed to do.
For instance, maybe you have many people who will come to your store to buy and pick up their products in person. However, you also have people who want to order online or over the phone and have it delivered to their house. Are you allowed to do this under the current laws?
You are, but there are some stipulations. For instance, your employee who makes the deliveries has to be properly registered in the CTS (Cannabis Tracking System). This means that you may make deliveries on the behalf of your company, but you can’t hire an outside company to do it for you. This is very important since third-party marijuana delivery is growing more and more popular with restaurants, grocery stores and even alcohol stores. You cannot use these services with marijuana products.
Interestingly, another key rule is that only a single delivery can be made to any one address during the day. A customer can’t order a second delivery for 24 hours. Even if another person in the same house wants to buy, you can’t deliver to that location again within the same 24-hour period.
This often will not matter, as most people won’t make multiple orders on the same day, but it does show why it’s so important to understand all of the laws and restrictions if you want to start this type of business.
